Privacy Policy
By signing up for the services of The Doctor Job (hereinafter “the Service”), contacting us by email or through our online contact form, and by reading this site, you acknowledge and agree to the following terms and conditions:
1. You agree not to reproduce, duplicate, copy, sell, resell or exploit for any commercial purposes, any portion of the Service, use of the Service, or access to the Service. The material on the Service is for the private, non-commercial use of readers only. Any other use is prohibited.
2. You are responsible for notifying The Doctor Job of any change in your mailing address, billing address, phone number or email address through our established address change forms in our client section. Any errors in shipping due to your failure to notify The Doctor Job will result in an additional shipping charge, determined at that time.
3. You agree not to use the Service to:
a. impersonate any person or entity, including, but not limited to, another individual in search of a legal position;
b. upload, post, email or otherwise transmit any Content that you do not have a right to transmit under any law or under contractual or fiduciary relationships (such as inside information, proprietary and confidential information learned or disclosed as part of employment relationships or under nondisclosure agreements);
c. upload, post, email or otherwise transmit any Content that infringes any patent, trademark, trade secret, copyright, publicity, privacy or other rights of any party;
d. upload, post, email or otherwise transmit any material that contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment; or
e. interfere with or disrupt the Service or servers or networks connected to the Service, or disobey any requirements, procedures, policies or regulations of networks connected to the Service.
4. You acknowledge and agree that The Doctor Job may preserve your personal information and may also disclose this personal information if required to do so by law or in the good faith belief that such preservation or disclosure is reasonably necessary to: (a) comply with legal process; (b) enforce the terms of service; (c) respond to claims that any of this personal information violates the rights of third-parties; or (d) protect the rights, property, or personal safety of The Doctor Job, its clients and the public.
5. Upon agreeing to purchase the Service, your credit card will be billed the entire amount in full. The amount will be determined by (a) use of the shopping cart in the medical students’ section, (b) a conversation with a representative of The Doctor Job, or (c) receipt of an email from your registered email address with payment information and approval. You will be informed of the total cost before the amount is charged. The Doctor Job will send you an email confirming the charge to your credit card and detailing the services you have purchased from us.
6. While we make every effort to verify all publicly available information regarding the employers in our database, we do not warrant nor do we accept any responsibility for the accuracy of the information made available by employers regarding their businesses - including, among other things, information regarding their office locations, specialty areas, number of practitioners and other information.
7. Returned mail policy. While we make every effort to keep the information in our database current, a certain small percentage of letters will be misdelivered to incorrect addresses. When you, as a client, receive returned letters, you must do the following:
(1) Log into the clients only section using your given username and password,
(2) Click the link “Receive corrected letters”.
(3) You will be presented with a list of the letters that you sent out. You must check the box corresponding to each returned contact, and click “Submit”. You must also un-check the box marked “I do not want new letters re-issued”.
(4) The Doctor Job will correct the addresses and print new letters, resumes, and envelopes for you. If there are any contacts that have retired or are no longer in existence, The Doctor Job agrees to provide you with a credit for those contacts that can be used towards another of our services.
If you do not un-check the box marked “I do not want new letters re-issued”, only a credit will be provided. Under no circumstances will we be responsible for (and under no circumstances will we issue a credit for) correct letters that you decide (for whatever reason) not to send. Under no circumstances will you be entitled to a credit for any letters with correct contact information that fall within the scope of the search criteria that you provide to us.
8. Cancellation or Revision of Services. Once you have spoken with a career counselor through email or by telephone and decided to proceed with our services, The Doctor Job will be providing a customized service for you that is based solely on your needs, and we begin each account on good faith that we will be finishing each order. AS A RESULT, WE CANNOT CANCEL AN ORDER OR REDUCE THE NUMBER OF CONTACTS ONCE THE ORDER HAS BEEN PLACED. If you need to place an order on hold due to finding a job or other reason, The Doctor Job will happily suspend the service until you are ready to search for a new job. At that point, we will happily perform new searches. The total number of contacts in the new search cannot be more than the original search without incurring any additional fees. If the new search is less than the original search, there will be no credit provided. All requests for cancellation must be in writing and directed to the attention of The Doctor Job Customer Service.
9. Notices of changes to the Service or to these terms and conditions may be made via either email or regular mail. The Doctor Job may also provide notices of changes to the Service or other matters by displaying notices or links to notices to you generally on The Doctor Job’s website at http://www.thedoctorjob.com.
10. Communication from you to The Doctor Job becomes the property of The Doctor Job and can be used for any promotional means without compensation of any form. Your personal information will never be used, except for your first name and last initial.
11. You hereby warrant and represent that you are at least eighteen (18) years of age (21 in some jurisdictions) and have the legal capacity to enter into agreements of this nature.
This constitutes the entire agreement between you and The Doctor Job and governs your use of the Service, superseding any prior agreements between you and The Doctor Job. You also may be subject to additional terms and conditions that may apply when you use affiliate services, third-party content or third-party software.
You agree that any and all disputes, controversies or claims arising under or in any way related to your relationship with The Doctor Job, including fraud in the inducement, or relating to the general validity or enforceability of any of the provisions hereof, shall be submitted to final and binding arbitration in Altamonte Springs, Florida under the auspices and rules of the American Arbitration Association. Furthermore, the relationship between you and The Doctor Job shall be governed by the laws of the State of Florida without regard to its conflict of law provisions. If, however, a dispute arises that is required to be adjudicated in court, you and The Doctor Job agree to submit to the personal and exclusive jurisdiction of the courts located within the county of Seminole, Florida.
The failure of The Doctor Job to exercise or enforce any right or provision of these terms of service shall not constitute a waiver of such right or provision. If any provision of the terms of service is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties' intentions as reflected in the provision, and the other provisions of the terms of service remain in full force and effect. You agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to use of The Doctor Job or the terms of service that you may have must be filed within one (1) year after such claim or cause of action arose or be forever barred.
