Terms and Conditions By signing up for the services of The Doctor Job (hereinafter “the Service”), contacting us by phone, email or through our online contact form, and by reading this site, you acknowledge and agree to the following terms and conditions: 1. You agree not to reproduce, duplicate, copy, sell, resell or exploit for any commercial purposes, any portion of the Service, use of the Service, or access to the Service. The material on the Service is for the private, non-commercial use of readers only. Any other use is prohibited. 2. You are responsible for notifying The Doctor Job of any change in your mailing address, billing address, phone number or email address in writing. Any errors in shipping due to your failure to notify The Doctor Job will result in an additional shipping charge, determined at that time. 3. You agree not to use the Service to: a. impersonate any person or entity, including, but not limited to, another individual in search of a legal position; b. upload, post, email or otherwise transmit any Content that you do not have a right to transmit under any law or under contractual or fiduciary relationships (such as inside information, proprietary and confidential information learned or disclosed as part of employment relationships or under nondisclosure agreements); c. upload, post, email or otherwise transmit any Content that infringes any patent, trademark, trade secret, copyright, publicity, privacy or other rights of any party; d. upload, post, email or otherwise transmit any material that contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment; or e. interfere with or disrupt the Service or servers or networks connected to the Service, or disobey any requirements, procedures, policies or regulations of networks connected to the Service. 4. You acknowledge and agree that The Doctor Job may preserve your personal information and may also disclose this personal information if required to do so by law or in the good faith belief that such preservation or disclosure is reasonably necessary to: (a) comply with legal process; (b) enforce the terms of service; (c) respond to claims that any of this personal information violates the rights of third-parties; or (d) protect the rights, property, or personal safety of The Doctor Job, its clients and the public. 5. By transmitting your information to The Doctor Job, through The Doctor Job website or by indirectly or directly submitting your information to The Doctor Job through any source where The Doctor Job may be advertised, you authorize The Doctor Job to contact you at the email address(es), phone number(s), and address(es) provided. 6. You understand that you are under no obligation to purchase the Service until you have communicated with The Doctor Job and explicitly agree to purchase the Service. Upon agreeing to purchase the Service, your credit card, debit card, or bank account will be charged the entire amount in full. If, in the discretion of The Doctor Job, the full amount is split into more than one payment, you understand that The Doctor Job reserves the right to collect the full amount by any means necessary in the case of a default. The amount due will be determined by (a) a conversation with a representative of The Doctor Job, or (b) receipt of an email from your registered email address with payment information and approval. You will be informed of the total cost before the amount is charged. The Doctor Job will send you an email confirming the payment and detailing the services you have purchased from us. 7. While we make every effort to verify the information regarding the employers in our database, we do not warrant nor do we accept any responsibility for any inaccuracy or incompleteness of the information. 8. Returned mail policy. While we make every effort to keep the information in our database current, a certain percentage of letters will be misdelivered to incorrect addresses. You acknowledge that this is unavoidable, and that The Doctor Job retains the right to correct the undeliverable letters or offer a credit towards the puchase of future services. In addition, you understand that The Doctor Job routinely provides letters in excess of the amount paid for. Any credit will be applied to this overage first. 9. Cancellation or Revision of Services. Once you have spoken with a career counselor through email or by telephone and decided to proceed with our services, The Doctor Job will be providing a customized service for you that is based solely on your needs, and we begin each account on good faith that we will be finishing each order. AS A RESULT, WE CANNOT CANCEL AN ORDER OR REDUCE THE NUMBER OF CONTACTS ONCE THE ORDER HAS BEEN PLACED. If you need to place an order on hold due to finding a job or other reason, The Doctor Job will happily suspend the service until you are ready to search for a new job. At that point, we will happily perform new searches. The total number of contacts in the new search cannot be more than the original search without incurring any additional fees. If the new search is less than the original search, there will be no credit provided. All requests for cancellation must be in writing and directed to the attention of The Doctor Job Customer Service. 10. Premium Services (or Gold Package). You acknowledge that by purchasing the Premium Services or Gold Package, you are authorizing The Doctor Job to insert your signature digitally into the cover letters and mail them on your behalf. Furthermore, you understand that any mailing done from The Doctor Job's offices may be done via Standard Mail, and the exterior your envelopes may contain a printed postage meter indicia, the abbreviation "Prsrt Std", and/or a barcode, which will facilitate your mailing process and ensure more accurate delivery. 11. Guarantee. a. Definitions. The following definitions shall apply to the guarantee: 1) A “Client” is a person who has agreed to and paid in full for the Bronze (or Basic) Package, Silver Package or Gold (or Premium) Package. Persons who purchase any other service, including but not limited to: resume, cover letter, or personal statement writing services, residency or fellowship mailing services, discreet mailing services, outplacement services, recruiting services, practice marketirng services or interview counseling services, are not considered clients under this definition. 2) “Market-Ready” means meeting the qualifications and requirements to begin work with a new employer as a physician, including being licensed and actively practicing. A Client who does not meet the requirements to work as a physician for any reason, including but not limited to age, mental defect, license, visa, criminal or professional misconduct, or certification, does not meet the definition of “Market-Ready.” 3) An “Eligible Client” is a Client who meets all of the following requirements: 4) A “Job” includes any job offer to practice as a physician within the United States or its territories, from any source including sources that cannot be immediately tied to The Doctor Job or its services. 5) The “Job Search Period” is the time period beginning when the person becomes a Client and ending within 180 days after the later of 1) becoming a Client or 2) being or becoming Market-Ready. b. Terms and Conditions Within 10 calendar days after the end of the Job Search Period, the Eligible Client must completely and correctly fill out the form at www.thedoctorjob.com/guarantee_form.html which will qualify the Eligible Client to take advantage of step one of this guarantee. The Doctor Job will subsequently prepare one additional mailing for such Eligible Client to mail to potential employers. If the Eligible Client has not found a Job within 180 days after sending out the second mailing, and if the Eligible Client has mailed out all letters within 5 days of receiving them from The Doctor Job, the Eligible Client may request a refund by notifying The Doctor Job through this form at www.thedoctorjob.com/guarantee_form2.html within 5 calendar days after the end of the above-described 180-day period. Within 60 days after receiving the Eligible Client’s request, The Doctor Job will refund the entire amount that the Eligible Client paid for the original services. When The Doctor Job provides the Eligible Client with an additional mailing, the total number of additional letters comprising the additional mailing will not exceed 100% of the number of letters that The Doctor Job provided for the Eligible Client’s original order. When providing additional letters in accordance with this guarantee, The Doctor Job will make every attempt to remain within the Eligible Client’s geographic parameters. If this is not possible, The Doctor Job will provide the Eligible Client with recommendations as to the best markets, and will prepare the additional letters in accordance with those recommendations. The Eligible Client must mail all additional letters within 5 days of receiving them from The Doctor Job. Within eight weeks of letters being mailed, the Eligible Client must mail all undeliverable mail back to The Doctor Job at the following address: The Doctor Job; Returns Department; PO Box 150160; Altamonte Springs, FL 32715-0160. Failure to meet any of the requirements described in this guarantee will cause this guarantee to be void. The use of fraud, misstatements or other inappropriate acts or omissions to bypass or circumvent any part of this guarantee will be pursued to the fullest extent of the law. The Doctor Job uses seeded contacts to determine that letters have been properly mailed, and will investigate to ensure that the guarantee is only available to those who are properly eligible. If the Eligible Client requests the additional mailing to be performed before the end of the Job Search Period, The Doctor Job will prepare this additional mailing at that time; however all subsequent rights under this guarantee, including the right to a refund, are forfeited. 12. Notices of changes to the Service or to these terms and conditions may be made via either email or regular mail. The Doctor Job may also provide notices of changes to the Service or other matters by displaying notices or links to notices to you generally on The Doctor Job’s website at http://www.thedoctorjob.com. 13. Communication from you to The Doctor Job becomes the property of The Doctor Job and can be used for any promotional means without compensation of any form. Your personal information will never be used, except for your first name and last initial. 14. You hereby warrant and represent that you are at least eighteen (18) years of age (21 in some jurisdictions) and have the legal capacity to enter into agreements of this nature. This constitutes the entire agreement between you and The Doctor Job and governs your use of the Service, superseding any prior agreements between you and The Doctor Job. You also may be subject to additional terms and conditions that may apply when you use affiliate services, third-party content or third-party software. You agree that any and all disputes, controversies or claims arising under or in any way related to your relationship with The Doctor Job, including fraud in the inducement, or relating to the general validity or enforceability of any of the provisions hereof, shall be submitted to final and binding arbitration in Altamonte Springs, Florida under the auspices and rules of the American Arbitration Association. Furthermore, the relationship between you and The Doctor Job shall be governed by the laws of the State of Florida without regard to its conflict of law provisions. If, however, a dispute arises that is required to be adjudicated in court, you and The Doctor Job agree to submit to the personal and exclusive jurisdiction of the courts located within the county of Seminole, Florida. The failure of The Doctor Job to exercise or enforce any right or provision of these terms of service shall not constitute a waiver of such right or provision. If any provision of the terms of service is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties' intentions as reflected in the provision, and the other provisions of the terms of service remain in full force and effect. You agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to use of The Doctor Job or the terms of service that you may have must be filed within one (1) year after such claim or cause of action arose or be forever barred. |
